Rest assured we have a Federal Firearms License which requires us or other dealers to have the buyer fill out the correct firearms purchase application (the 4473) and do the NICs Federal background check when buyers cannot provide a valid CCDW license.  This serves to better protect the seller showing that they made every reasonable effort to ensure against the unthinkable happening.  Some in our industry use a loophole to circumvent the safer transfer of firearms, they sell guns to unknown or undocumented buyers for cash, we don't.  Doing it the right way costs us a little bit more in paperwork and aggravation however we want to protect our client the seller and the general public.

Terms & Conditions

1. All Federal, State, and local firearms laws will apply to this auction. We are a licensed FFL dealer and are required to transfer all firearms being sold or ship them to another licensed dealer in your area.
2. All firearms sold must be transferred into the buyer’s name. Each buyer must complete in full, ATF form 4473. Once the form is completed and the buyer presents a paid receipt, we will call the ATF for the instant check also known as the NICS check. Once approved, we will allow the buyer to take possession of the firearm. In the event that the NICS check system puts a hold on the transfer, the buyer will have to wait up to 3 business days and then pick them up at our office if approved. Holds are normally rare but be aware just in case one happens and realize that we have no control over it. If you have a valid state issued concealed carry permit/license the NICS check will not be necessary.
3. Everything must be paid in full within 48 hours of the sale ending and prior to the removal or shipping of any items.
4. We accept cash, good local check with bank letter and proper ID, Visa, MasterCard or Discover also with proper ID or bank to bank wire transfer.
5. Everything sold is sold “as is where is” with no warranties expressed, written, or implied. If a new or used firearm has a manufacturer’s warranty, you as the buyer must deal directly with the manufacturer.
6. We will be charging a buyer’s premium of 15% on all purchases. Sales tax will be collected if you live in the state of Kentucky or pick your items up locally. Only FFL’s that intend to resell the firearms will be exempt from sales tax on firearms however they will need to provide a copy of their resale certificate and fill out the state exemption form.
7. If having your firearms shipped. the buyer's licensed dealer MUST Email or Fax a file copy of their FFL to us within 7 Days. All items not picked up or unshipped after 14 Days will result in a $25/week Storage Fee. Furthermore, any items not picked up or unshipped after 90 Days will be considered Abandoned by the buyer and will be Forfeit without Refund or Credit of any amount or type. This rule is the result of a previous buyer that had us store his purchases for 11 months before sending his FFL even though we contacted him numerous times via email and phone to no avail.
8. If an item is purchased by an individual that cannot legally possess the item due to Federal, State, Local laws or regulations, payment in full is still required & we will accept the individual as a future consignor for the item to be resold at a later date in one of our upcoming auctions. Standard firearm consignment rates will apply in that case. In this case you will at no time take possession of the item or items. You are required to be aware of all Federal, State and local laws governing your ability to purchase Firearms, ammo or accessories prior to bidding.
9. Shipping is the responsibility of the buyer. Shipping Saint will offer a quote for shipping items once purchased to a designated location, but in no way will we be held responsible for items once they leave our location. It is recommended you purchase insurance on shipments especially with firearms.
10. We reserve the right to approve or decline a bidder at any time.
11. Employees and associates of Auctions ASAP are permitted to purchase lots at competitive bidding under the same terms, rules, and regulations as the general public.
12. In the event of a Technology issue of any type, Auctions ASAP reserves the right to stop the auction, extend the bidding, pause bidding, cancel the auction, reschedule the auction, or to remedy the situation in any other way they see fit. We are not responsible for your internet connectivity, third party bidding platforms, servers, computers, phones and handheld devices of any kind. A recommendation is to place your bids much earlier than a few minutes before the items are scheduled to close.
13. We may from time to time reach out to bidders to verify their accounts and bidding activity. We will attempt to contact you via email, text, phone call or have Proxibid staff reach out to you directly. In the event you are unavailable for this security check we reserve the right to freeze your bids or remove them entirely. Please make sure your account information is correct and that your phone number is one that you will answer should we need to speak with you. Further you agree to allow us to contact you for useful auction notices in the future.
14. By registering and bidding in this sale, all bidders acknowledge that they agree to the terms of the sale. If you disagree with any of the terms and conditions do not bid in this sale because you will be held to them.
