Terms & Conditions

  • The Auction is an Absolute Auction, meaning No Minimum, No Reserve, and Selling to the high bidder regardless of price.

  • To bid you must have a bidder number.  When you register and provide proper state issued ID you will receive a bidder number.

  • By registering you are agreeing to pay in full prior to any removal, no exceptions.

  • We accept cash & local check with proper ID.  Non-local or an out of state check will require a bank letter of guarantee.   Please note that if you’re buying a bus or work van, the payment must be made in full and title transferred prior to its removal unless you are a licensed dealer.

  • Everything sold is sold “as is where is” with no warranties expressed, written, or implied.   

  • We will be charging a buyer’s premium of 10% on all purchases.  Example- If you win an item for $10, the buyer’s premium added will be $1 for a total of $11 before sales tax.

  • According to the State of Kentucky sales tax must be collected at today’s sale. 

  • The auction will be recorded for accuracy.  If in the unlikely event a mistake is made recording a bid, AFTER the auction is over we will play back the recording.  Should the recording reveal a mistake, we will make the appropriate adjustment either in your favor or the sellers.

  • In the event that there appears to be confusion as to a tied bid or to which lot is currently being auctioned, the auctioneer under his sole discretion may reopen bids to those bidders involved or he may reopen bidding to all bidders. 

  • The Auctioneer reserves the right to accept bids in any increment he feels is in the best interest of his client the seller. The Auctioneer reserves the right to reject the bidding of any person or persons whose conduct, actions, or adverse comments he feels is not in the best interest of the seller.  In the event that the auctioneer deems there to be collusion among bidders, the auctioneer may take appropriate actions including cancelling the auction.

  • If an absentee bid has been left, the auctioneer will not be held liable if it is not placed or if the absentee bid ends up being tied with a bid from the floor that does not end with the absentee bidder being declared the winner.

  • Once an item sells, you are fully responsible for any loss, damage or theft that may occur.  Be sure to watch your stuff.

  • We expect that most if not all smalls will be removed following your payment today.

  • Some of our crew or employees of BCPS may be bidding on a few items today but we can assure you that they will be held to all the terms everyone else is including the buyer’s premium and sales tax.  Any questions contact our office.
